Legal Documents v2.4
Terms of Service
Welcome to WebMaster HK's services. Before starting any project, please read the following terms carefully. These terms aim to protect the legal rights of both parties and ensure projects proceed in a trusting, professional environment.
1. Service Scope & Quotations
WebMaster HK (hereinafter 'the Company') provides services including but not limited to web design, mobile app development, search engine optimization (SEO), digital marketing, and website maintenance. All quotations are based on the client's initial requirements. If requirements change significantly during development, the Company reserves the right to adjust quotations and development timelines.
2. Payment Terms
The general payment flow is: 50% deposit upon contract signing; 30% after UI/UX design confirmation; remaining 20% after project launch and acceptance. Once the deposit is paid, it is non-refundable except in cases where the project cannot start due to the Company's reasons.
3. Intellectual Property & Ownership
After the client has settled all payments, ownership of the final deliverables (including code, designs, and database architecture) will be transferred to the client. The Company reserves the right to showcase the project in its portfolio unless the client explicitly requests confidentiality in writing. Third-party licensed components, fonts, or images used by the Company remain the property of their original authors, and the client must comply with relevant license agreements.
4. Maintenance, Support & Hosting
Projects typically include 12 months of basic technical support (bug fixes) after completion. If the client chooses a non-recommended hosting server, the Company does not guarantee website performance or security. The Company is not liable for business interruptions caused by third-party services (e.g., domain registrars, server providers, Google APIs).
5. Limitation of Liability
Under no circumstances shall the Company be liable for indirect losses or lost business profits arising from website failures, downtime, or data loss. The Company's cumulative liability shall in no event exceed the actual service fees paid by the client for that specific project.
6. Modifications & Termination
The Company reserves the right to modify these terms of service at any time. Modified terms take effect from the date of publication on the website. If the client breaches the contract or fails to pay fees on time, the Company has the right to suspend or terminate related services and reserves the right to pursue legal liability.
Conclusion & Legal Effect
These terms are governed by the laws of the Hong Kong Special Administrative Region. If disputes arise during contract performance, both parties shall resolve them through friendly negotiation; if negotiation fails, litigation shall be brought before the courts of the Hong Kong Special Administrative Region.
